my "friend" is 17 her bf is 21 is that illegal

my "friend" is 17 turning 18 in july 2008 and her boyfriend is 21 he'll be 22 in january 2008 so right now shes 17 n hes 21 is that illegal like the consent age is 16 in michigan but shes scared its illegal and if her dad doesnt like it he'll press statitory(sp) rape charges but if she consented it it wouldnt matter right???? please help!!
