Question

Step parent's child support responsibility

Sent to Legal Experts January 27, 2006 4:02 p.m.

I am a single mom with two young children who is currently dating a man without children. He is rightfully concerned that if we move in together and it doesn't work out, that I may come after him for child support. I have absolutely no desire to do that - I don't believe that's fair to him and would never even entertain the idea. I do receive child support from their biological father.

I understand that by law, he may become responsible for paying child support if he has taken on the 'parent' role to my children. Is there anything I can do before we move in, such as a signed contract or an agreement, that would state that I, unequivocally will not ask for child support in the event of us separating? We live in BC, Canada.
