Question

Single mother custody rights

Sent to Legal Experts February 24, 2006 1:44 p.m.

I am looking for information regarding a single mother's custody rights where the father has been absentee but now wants some sort of custody for himself. There has been no money given for support, and the father has seen the child twice in four months.

Thank you.

Optional Information:
Tampa, Florida

Already Tried:
Speaking to a lawyer to have the father sign papers saying he won't have to pay if he agrees to supervised visits. The lawyer said this was not possible.

Dear Elka,

The issue of the father's rights are not contingent upon your rights as a mother.

The rights of mother';s and fathers as parents, whether living together or apart, are related to the welfare of the child.

The father cannot be compelled to give up or waiver his custody and visitation privileges without grounds such as abuse and willful neglect.

In this instance, your attorney is correct.
