Custody: Brother received custody of three boys along with new wife approx 8 yrs ago. Now getting a divorce from wife and having to fight for custody of biological children from wife who did not adopt children. In Michigan. Brother charged with domestic abuse towards wife and meth during the break-up. Does he have to fight for custody of his own children from current wife?

Yes, more than likely your brother will have to fight for custody as he was charged with domestic abuse.....the court, naturally, is concerned for the safety and well-being of the children. However, being that his soon to be ex-wife did not adopt them, the judge will probably give her temporary custody unless there are other relatives who will come forth and petition the court for custody. The judge will probably order your brother to attend anger management classes, therapy and any other program that the court deems just and proper, then after a certain period of time, your brother can appear before the court for reassessment - perhaps the judge will then award your brother custody. If the accusations against your brother were false, then there is nothing to worrry about as long as there's proof of his innocence.
