I have been married for 20 months. My husband and I have a prenuptial agreement which states that basically whatever is in his name is his and vice versa. He and his 3 kids (ages 15,13,11) moved in my home. He sold his and pocketed the money (He was a builder and owned his business) He has several rentals also. I need to know how hard it will be for me to make him leave my home and how long it may take since he and his kids are here. He does have other places to go but he''s very spiteful and will make things as hard as possible for me. I have continued to pay my mortgage. He has paid the electric, cable and phone bills since Sept. 07.

I've told him to get out. He says it will take him a year. I'm tired of being his and his kids maid. They don't live as I do.

You need to file with the local clerk of court in your county to being eviction procedures or simply file to gain possession of the premises. They should have the necessary forms at their office for you to file but I would call just to make sure. You can also find out more HERE; this is a Writ of Possession to gain possession of your residency from him and his children (the instructions are HERE). He, like any other tenant, is only required to have 30 days to vacate and then you can file for the Writ of Possession. You can read more HERE.
