My son recently (February) had a baby with a girl who

My son recently (February) had a baby with a girl who is currently still married,she put the last name of the baby''s the same as hers without consulting my son.Since then they have taken a DNA test and he is the father and wants his name on the birth certificate.The girl is now living with him and wants the name to.The problem is the husband is very combative and will not agree to signing off on removing his name from the birth certificate.Is there an easy way to get this done since the girl is willing to say he is and prove my son is the father?

We are just getting started.We were hoping the girl would be able to get it done but she is afraid of the husband from what she says.

If a child is born in wedlock the husband is the presumed father. First the woman should get a divorce and in that proceeding she can establish the paternity of the child and she will need to show that her husband has no fatherly bond with the child and that she wants the birth certificate changed. As long as the court finds that your son is the father and that the husband has no custody right or support obligation it can all be settled.

That would be easy but this guy is not giving her a divorce anytime soon.My son would like to put the baby on his insurance plan at work so we would like to know if there is another way to file for paternity
