My ex-wife has full custody of our 2 year old son. I pay child support every week out of my check and also carry medical insurance on him. Very recently, my ex-wife called me and told me that I needed to come pick our son up from her because she was kicked out of the house by her boyfriend. As of now, my ex-wife has no place to live and is driving a rental car because she and her boyfriend wrecked her truck. Our son has been staying with me for a week now. I spoke with the babysitter about my son going there part-time. She agreed to this at $45 a week. Now that I am paying for child care out of my own pocket and child support is still being taken out of my check with my child living with me, how can I handle this situation with a lawyer? I would like to have temporary custody of my son and also would like to fight for joint custody if not full custody. How can I go about doing this? OR what should i do

While you have your child living with you, you need to go file a petitoin for temporary custody explaining in the petition that the child is currently living with you, that the mother has no place to live, and has asked you to keep the child in your home.

You need to also file a Petition for custody as well as a motion to quash child support. If you don't file a Motion to quash child support, you will still have to continue paying the child support to your ex-wife so as to avoid being in contempt.

I would highly suggest getting these documents filed quickly as most Judges are more likely to order temporary custody if the change will not upset the child. The fact that your son is with you should help in getting this granted.
