My daughter has filed divorce and her husband wants liberal ...

My daughter has filed divorce and her husband wants liberal custody. We are not sure what this is. He lives in another state and the child is 4 months old. We do not contest the father seeing the child but what we will not agree to is taking the child out of state and "just popping in". We want to be notified of any visitaion. How should my daughter file for custody? She filed restricted and this is what they are contesting. Thank you, God Bless,

Thanks for your question. I would tell you that you that she should argue for primary custody because of the distance involved between the parties. If your daughter has filed for divorce I am assuming that she asked for primary physical custody and structured vistation.

I would agree with you that especially with the distance involved this might be better for your daughter and child/children. In general courts tend to favor joint custody. But in a situation where there is distance involved and I'm guessing some animosity of the parites this may not be workable. You daughter may be entitled to spousal support as well. I understand that it may be hard to hire a lawyer financially but she would benefit greatly by doing so. She would want to ask for this in her situation if she has limited income and job prospects. This would allow her to obtain further training and education as well.
