I have a 22 yr. old daughter who will be a senior in college next year. This is the second year I have had to take out student and Parent Loans. Her father helped pay on last years loan so the one is payed off, but his said he will not help on any other loans. When she graduates with her Masters I will have 4 years of loans I will have to pay on. Do I have any leagal rights that say, her fathers needs to help pay on these loans since she is still in school?

Hello,

California law does not allow the court to impose continuing support beyond the age of 19, unless the child is physically or mentally disabled or otherwise incapacitated from earning a living. However, if the parents have agreed that child support is to continue into the college years, such an agreement will be enforced by the Family Law Court.

If there was no agreement made in your court order, then he can not be forced to provide child support or help to pay for any collage expenses. Child Support ends at the age of majority as the child is deemed a adult and responsible for their own support.

You can petition the courts and ask that half of the collage loans be paid. Typically these cases are denied as a parent can not be legally forced to pay for collage in the state of California.
